Just who the Hell is in charge here?

The face of the liar:

A lot of conservative sites have noted the report by NBC News — an organization which very much favors the Democrats — that the Obama administration knew millions could not keep their health insurance, but Robert Stacey Stacy McCain put it best:

How bad is the failure of ObamaCare? Bad enough that MSNBC’s Morning Joe can’t ignore it, says Pete Da Tech Guy. While they cannot ignore it, however, the liberal media must find some explanation that makes this failure look less predictable than it was, and how to make President Obama’s deliberate lies look like innocent errors:

President Obama repeatedly assured Americans that after the Affordable Care Act became law, people who liked their health insurance would be able to keep it. But millions of Americans are getting or are about to get cancellation letters for their health insurance under Obamacare, say experts, and the Obama administration has known that for at least three years.
Four sources deeply involved in the Affordable Care Act tell NBC NEWS that 50 to 75 percent of the 14 million consumers who buy their insurance individually can expect to receive a “cancellation” letter or the equivalent over the next year because their existing policies don’t meet the standards mandated by the new health care law. One expert predicts that number could reach as high as 80 percent. And all say that many of those forced to buy pricier new policies will experience “sticker shock.” . . .

The emphases were Mr McCain’s, not the cited NBC News story’s. But he’s Mr McCain’s money line:

So all those promises — that rates would go down and that people could keep their existing plans — were deliberate lies. And all the conservatives who tried to warn that ObamaCare was doomed to failure were correct. But the liars were all Democrats, and the people who told the truth were all Republicans, so there will be no apologies and no repentance. Instead, they’ll just come up with new lies.

The emphasis in that one was mine, not Mr McCain’s.

The problem is documented further down in the NBC story:1

None of this should come as a shock to the Obama administration. The law states that policies in effect as of March 23, 2010 will be “grandfathered,” meaning consumers can keep those policies even though they don’t meet requirements of the new health care law. But the Department of Health and Human Services then wrote regulations that narrowed that provision, by saying that if any part of a policy was significantly changed since that date — the deductible, co-pay, or benefits, for example — the policy would not be grandfathered.

Buried in Obamacare regulations from July 2010 is an estimate that because of normal turnover in the individual insurance market, “40 to 67 percent” of customers will not be able to keep their policy. And because many policies will have been changed since the key date, “the percentage of individual market policies losing grandfather status in a given year exceeds the 40 to 67 percent range.”

That means the administration knew that more than 40 to 67 percent of those in the individual market would not be able to keep their plans, even if they liked them.

Yet President Obama, who had promised in 2009, “if you like your health plan, you will be able to keep your health plan,” was still saying in 2012, “If [you] already have health insurance, you will keep your health insurance.”

“This says that when they made the promise, they knew half the people in this market outright couldn’t keep what they had and then they wrote the rules so that others couldn’t make it either,” said Robert Laszewski, of Health Policy and Strategy Associates, a consultant who works for health industry firms. Laszewski estimates that 80 percent of those in the individual market will not be able to keep their current policies and will have to buy insurance that meets requirements of the new law, which generally requires a richer package of benefits than most policies today.

More simply, they took a law which would have made the President’s proclamations false to (possibly) less than half of the people, and added administrative regulations — they did not amend the law — which made the statements false to the majority of the people. Former Speakess of the House Nancy Pelosi (in)famously said that “we have to pass the [health care] bill so that you can find out what’s in it…,” but a very major part of the problem is not what was in the bill but what the Department of Health and Human Services has added on to the bill in the form of regulations. The regulators knew what the President had promised, and wrote regulations which deliberately broke the President’s promises.

As noted, virtually everybody on the blogroll has written about the President’s lies (see the Related Articles section below), but, to me, this is just one more bit of evidence. On The Five, Andrea Tantaros noted President Obama’s claim that he did not know that the intelligence agencies he controls were taping the cell phone of German Chancellor Angela Merkel.2

Miss Tantaros asked the panel if they believed the claim that the President did not know; my point would be that it’s actually worse if I do believe it. If I don’t believe it, it makes the President of the United States a liar, which we already knew. If I do believe it, then the obvious questions have to be:

  1. Who authorized the tapping of the phone of the chief of state of one of our closest allies;
  2. Who decided that that kind of decision was below the Presidential level;
  3. Who decided that the President should not be informed of such a decision; and
  4. Just who the Hell is in charge here?

And it gets even worse. It’s bad enough that the President has urinated off a lot of our allies with the surveillance program,3 but then they pull this [insert slang term for feces here]; from The Wall Street Journal:

U.S. Says France, Spain Aided NSA Spying

WASHINGTON—Widespread electronic spying that ignited a political firestorm in France and Spain recently was carried out by their own intelligence services and not by the National Security Agency, U.S. officials say.

The phone records collected by the Europeans—in war zones and other areas outside their borders—then were shared with the NSA, U.S. officials said, as part of efforts to help protect American and allied troops and civilians.

The new disclosure upends the version of events as reported in Europe in recent days, and puts a spotlight on the role of European intelligence services that work closely with the NSA, suggesting a greater level of European involvement in global surveillance.

The U.S. has so far been silent about the role of European partners in these collection efforts so as to protect relationships. These efforts are separate, however, from the U.S. spying programs that targeted dozens of foreign leaders, including German Chancellor Angela Merkel, whose phones were tapped for years by the NSA.

The NSA declined to comment, as did the Spanish foreign ministry and a spokesman for the French Embassy in Washington. A spokesman for Spain’s intelligence service said: “Spanish law impedes us from talking about our procedures, methods and relationships with other intelligence services.”

More at the link.  It looks like our European allies need to get used to what the President’s domestic allies have had to worry about, getting thrown under the bus. It was damaging enough for the United States to have the surveillance program exposed, but at least the damage could have been limited to the United States. Now, someone has taken the decision to damage our allies as well.

It all could have been handled by the US telling our exposed allies, “Look, this has been bad, and we understand that you have to say some unpleasant things about us, but we’ll keep your involvement quiet and let all of this settle down in a few months.”  Instead, someone decided that the best way to make us look less bad is to make some of our allies look bad. Someone needs to read Dale Carnegie, because someone in the Obama Administration has all of the interpersonal skills of Sheldon Cooper and all of the brainpower of Sheila Jackson-Lee.

Now, just what rocket scientist decided to put out that story? As important as this story is for our foreign policy, that decision had to come from the top, from President Obama. If it did not come from President Obama, then someone needs to be fired, and fired immediately, and it, once again, raises the question: just who the Hell is in charge here?

Sadly enough, as bad as it is that Barack Hussein Obama is supposed to be in charge, it appears to me that it’s even worse than that, that no one is in charge. President Obama, Secretary of State John Kerry, and Director of National Intelligence James Clapper simply are not stupid enough to have decided to leak that story.

This story is even worse than the obvious lies that were told by the Obama Administration concerning the Obaminablecare fiasco; I am concerned that the health care story is so big that the more important one is going to be lost in the noise.

    America’s top intelligence official acknowledged Tuesday that President Obama and other senior White House officials were well aware of U.S. surveillance activities targeting leaders of friendly foreign nations — a stark contradiction of the administration’s insinuation in recent days that the president was unaware of such spying.

    Director of National Intelligence James R. Clapper described the targeting of foreign leaders, including American allies, as a “fundamental” aspect of intelligence gathering, and said neither the CIA nor the National Security Agency can tap into a given leader’s private communications without White House oversight.

    His testimony, made during a series of tacit exchanges Tuesday with members of the House Select Committee on Intelligence, came as all sides in Congress have begun seriously examining legislative proposals that would rein in the legal framework surrounding the NSA’s snooping programs.

    Two lawmakers introduced a bill Tuesday that would end the agency’s legal ability to collect and store massive amounts of private, albeit basic, telephone metadata, while a separate Senate proposal would allow the data gathering to continue under new oversight requirements.

    Despite his broad characterizations about the program and the White House’s knowledge of it, Mr. Clapper sought also to defend Mr. Obama during the intelligence hearing, saying that while the president is briefed “quite frequently” on the scope of surveillance operations, it would be “unrealistic” to think his staff regularly goes over specific details, such as explicitly how or when the intelligence is being gleaned.

    WASHINGTON — President Obama finds himself under fire on two disparate fronts these days, both for the botched rollout of his signature health care program and for the secret spying on allied heads of state. In both instances, his explanation roughly boils down to this: I didn’t know.

    As a practical matter, no president can be aware of everything going on in the sprawling government he theoretically manages. But as a matter of politics, Mr. Obama’s plea of ignorance may do less to deflect blame than to prompt new questions about just how much in charge he really is.

    In recent days, the president’s health and human services secretary said that despite internal concerns and a failed test run Mr. Obama was not told about serious problems with the new program’s website until it was rolled out this month. Other officials said the president was not aware that the National Security Agency was tapping the phone of Chancellor Angela Merkel of Germany and other friendly leaders until this summer, although intelligence officials said Tuesday that others in the White House had known.

    Opposition lawmakers and pundits have seized on the White House explanations to accuse Mr. Obama of being a “bystander president,” as the Republican National Committee put it. Even some Democrats are scratching their heads at the seeming detachment from significant matters. MSNBC’s “Morning Joe” ran a montage of clips showing Mr. Obama or his aides disclaiming presidential knowledge of various issues as well as a graphic titled “Implausible Deniability.”

    Of course, it’s easy for the Times and other de facto Democrat house organs to be be honest about the President now, now that being honest doesn’t mean that Mitt Romney would become President. But, let’s face it, things have got to have gotten pretty bad for the liberals to have broken their sycophancy.

    Obama’s loyal liars are promoted, Susan Rice is a particularly egregious example. She went on national TV and told an obvious string of lies about the terrorist attack on Benghazi to conceal the Administration’s culpability, which although it made her a laughingstock and marked her as so devoid of personal and public integrity as to be permanently unfit for public (or private) office, as well as overly qualified for incarceration for participation in a criminal conspiracy to conceal material facts in the death of 4 Americans, it also ensured she would be vigorously defended by WH apparachiks and then appointed to higher office as a reward for betraying her country.

    For Obama’s true believers the way they demonstrate loyalty to him is to prove they have none for our country.

  6. It seems to me that in order to muster any indignation at all over the supposed “incompetence” of the Administration you either have to:

    1, admire excellence of execution above all else, no matter what the end intended,

    or

    2, Imagine that somehow despite all the evidence, and the testimony of Obama himself, he is not really morally other, nor out to fundamentally transform America from what it once was, i.e., a constitutional polity founded on the premise of natural rights, into a social solidarity or fascist state.

    It’s like expressing outrage when a vandal who has gained formally legal access to your house decides to wreck another room, and gets a little sloppy with the crow bar.

    I mean really, what’s the point of even assuming anything like good intentions on his part in the first place? What point is there in evaluating how deftly he handles the wrecking bar?

    Obama is there to squat on our republic, and to along with his state dependent clients and their manipulators, make this country their toilet.

    1. Allow plans across state lines
    2. Tort reform/malpractice reform
    3. Force, yes force, the poor into Medicaid
    4. Allow individuals to deduct their HC premiums like businesses do
    5. Remove the federal government from HC except Medicaid and Medicare
    6. Make all plans “contributing” including government and union plans at 50% of premium
    7. Throw out illegal aliens

    Although ObamaCare was forced on an unwilling nation by an exclusively partisan vote, it was indelibly corrupted by special back room deals right from the start (Cornhusker kickback, the Missouri Compromise, the Louisiana Purchase, the Bay State Kickback, $100 M for Chris Dodd’s (D-VT) favorite hospital, special access to Medicare for the town of Libby, Montana, courtesy of Max Baucus (D-MT), special provisions for Florida’s many retirees, and an extra $8.5 B for Medicaid earmarked for 11 favored states and DC, etc, etc, ad nauseum) which were pay-offs for wavering Democrats who then shamefully cast their vote in the dark of night on Christmas Eve without one single GOP Congressman in agreement. The American people opposed ObamaCare, it got not one GOP vote, and it fails to deliver on any of it’s cost saving promises. So, what’s the point?

    The point is ObamaCare was never intended to improve health care for ordinary Americans, which is why it doesn’t work. It’s secondary function was to reward Obama’s loyal welfare and food stamp supporters at the expense of squeezing Middle Class taxpayers into poverty and reducing them to dependency on the Federal government by strangling small business with suffocating health insurance regulations.

    But, it primary function was intended to put the Democrat Party’s unionized Washington bureaucrats (themselves exempt from ObamaCare) in a position of control over individual citizens. By taking control of an issue as immediate and as personal as healthcare away from individuals, Obama’s bureaucrats would have a mechanism at hand to force unruly Americans to give up their guns, recycle, eat bean sprouts, drive electric cars, or pray to Allah.

    Obama fully intends to reduce Americans to abject subservience to his dictates, and he really doesn’t give a damn what the Constitution says, and that goes for voters too. He intends to steal the 2014 election and put his bootlicking Democrat toddies in charge of the People’s House. Obama knows that it’s not important who votes, it’s only important who counts the votes and he intends to teach that lesson to a once proud people who have neglected to protect the freedoms their fathers and forefathers paid for in blood.

    Once it was Give me liberty or give me death! Now, it’s Sure, I’ll take ObamaCare and throw-in a new cell phone to go with my food stamps and welfare check.

    I don’t usually employ personal anecdotes as illustrative in matters of real importance. So-called human nature truths revealed on hunting trips, or kids’ of ideas of fairness as equality (“But only for the things you like”), or me as a kid naively asking my Dad why “they” didn’t just kill all the foreign spies they discovered instead of trying to arrest them (I had a grandiose and not very clear idea of what his job had been anyway) are not such big matters.

    But what we have all seen by the age 40 is older people die. And often it takes a long time. And quite often they are seemingly at death’s door when they unexpectedly recover with treatment continued beyond what seems “reasonable”. And sometimes they do slowly die in ways wherein palliative care and physical therapy goes on for a long while, even though their fate is sealed more or less.

    A friend of mine, a much older employee actually, who acquired a smoking habit back in the 50′s when he was young and in the military, developed serious emphysema a few years back. The condition killed him recently. But before it did he was hospitalized off and on for months; and was involved in repeated treatments for pneumonia and other related ailments.

    He had made good money, he had good insurance, and at his age medicare (which becomes part of the problematic here) was involved. But there was a great deal of expensive therapy entailed in just keeping his lungs operating.

    The alternative of course was a slow, labored, suffocation.

    It’s not too difficult to calculate that when some nihilistic OCD case with delusional feelings of entitlement, someone like the execrable moral imbecile Lena Dunham, is confronted with a choice between cheap birth control for itself and an elderly person’s continued life, it will unsurprisingly chose for itself, and try to justify the choice on some social utility calculus. On a “social calculus” that is, which would not even obtain unless the kind were not social fascists in the first place. The critical point being, that it is only because of the fascist impulse to coercively bundle fates in the first place that there is any imagined connection.

    But the fascist kind first binds together as if all were fungible elements, and only later complains of the costs involved in having stupidly and immorally done so.

    Fascism, has had it’s tentacles into this country for a long time of course. There were plenty of fascist forerunners around at the time of the Civil War. Their wild eyes had seen what they took to be the glories of political consolidation, social amalgamation, “free love” and a suspiciously homoerotically tinged nationalism.

    But with the individual mandate, with an in-principle unlimited Federal claim against all who are born, as being liable to serve “the system” all their natural lives, we have entered into a new phase that takes us well beyond the excise tax fiction of the Income Tax, and the various legal fig leaves that made “social security” and medicare palatable for some.

    We will soon learn what the government’s forcibly committing one “to a shared fate” with, well, moral garbage like Lena Dunham or Sandra Fluke’s friends, or Phoenician in a Time of Romans, really means.

    First he would not have the moral or physical courage to do so in person.

    And, in the case of someone like “himself”, one who has drifted outside of what he views as “confining” rather than defining, gender roles, or the very idea of masculinity, he would have no problem in admitting it. He would have no problem in admitting to cowardice, or duplicity, or any kind of dishonor; since honor – even in the best of senses – is simply not part of his moral vocabulary.

    Second, once you saw him you would be reminded of what an absolute physical and intellectual nonentity he is. Some people are simply beneath the kind of response you mention. The only stature he gains is had by trying to claw his way up your trouser leg.

    Speaking anecdotally once again, I was dealing with some pseudonym hopping lefty clown during the RKBA debates who was so angry with my posts on constitutionalism, rights, and natural law, that he did a Mike Ganzeveld, and began to (trying anyway) stalk and threaten when he couldn’t win an argument.

    Keeping an even tone in reply seemed to enrage him all the more.

    Annoyed, and on the basis of this, I went to a protest march website he had boasted of attending, and almost instantly noticed an image of some pug faced and bespectacled clown holding up a hand-made sign with exactly the same abusive verbiage and phrasing he was so fond of deploying on the discussion board.

    Short version is that I captured what must have been his picture, and posted it for a laugh. He went nuts. Got worse. Threats of legal action. Insinuations that I had hacked his computer. Going to the FBI, he was. Pretty funny that. But not so funny in general.

    Finally I got fed up, and went to some friends and said, “find this guy”. They said no problemo. And they did..

    The next time he went on a rampage, I simply responded civilly using using his name. Pffft, he was gone.

    So before you buy into the sticker shock hysteria, here are four questions you should ask:

    1. What does the old plan actually cover? Most of the policies in the existing individual health care market — which are currently issuing notices — offer low premiums, but also come with skimpy benefits and high out-of-pocket costs. These plans often have low limits for outpatient treatment, hospitalization or don’t offer any benefits for procedures like colonoscopy, chemotherapy or mental health treatment. Insurers market these policies to young and healthy people who don’t use their coverage — and never know the true extent of their benefits. (The market is also fairly mobile, with just 17 percent of individual subscribers purchasing the same plan for two years or longer.)

    Under the Affordable Care Act, insurers cover 10 essential categories of benefits, offering far more comprehensive coverage than what’s available in most individual insurance plans.

Insurers informing policy holders that their health care costs will go up, often direct beneficiaries to their other brand products without telling them about competitive options and prices available through the exchanges.     Prices are lowest in areas with the most insurer competition. An analysis from the McKinsey Center for U.S. Health System Reform found that “new entrants into the market make up 26 percent of all insurers,” and “tend to price their plans lower than the median premiums in their market.” The average premium in the exchanges is 16 percent lower than previously projected.

    3. Yes, the premium is low, but what are the co-pays and deductibles? This coverage often forces individuals who do use care to meet high deductibles — the amount you pay out-of-pocket before your insurance kicks in — pay high co-pays and co-insurance or limit the number of doctor visits that are allowed. Cavallaro, for instance, must meet a deductible of $5,000 a year and has an out-of-pocket cap of $8,500 a year. The plan covers just two doctors’ visits and each include a $40 co-pay.

    As the LA Times’ Michael Hiltzik points out in California, Cavallaro could sign-up for a Silver level plan with a $2,000 deductible, maximum out-of-pocket cost of $6,350, pay $45 for a primary care visit and $65 for a specialty visit — “but all visits would be covered, not just two.”

    The health law sets exchange enrollees’ maximum annual out-of-pocket costs at $6,350, and silver plans have deductibles ranging from $1,500 to $5,000.

    4. Does this person qualify for subsidies? Americans between 100 and 400 percent of the federal poverty line ($46,000 for an individual, or about $78,000 for a family of three) qualify for tax credits under the law. Six of the 7 million individuals who are expected to sign up for insurance through the exchange will receive an average tax credit of $5,290 per year.

    Cavallaro “qualifies her for a hefty federal premium subsidy,” Hiltzik reports and can purchase a silver plan for $333, $40 more than she’s paying now. A cheaper bronze plan would be in the $200s.
